SALES TAX UPDATE: TOKEN SALES

Tom Hoffman Jr with Hoffman Car Wash just participated in a conference call with NYS Taxation staff regarding their upcoming release of a sales tax bulletin related to car wash issues.  One of the examples in the bulletin states: “A customer purchasing gas at a gas station that has an automated car wash facility is asked at the pump if the customer wants a car wash.  The customer decides to purchase a car wash and, after paying at the pump or paying the attendant, receives a token to use to enter the car wash.”  Taxation staff told Tom that this type of car wash service is not subject to sales tax. They also told him that if you have an attendant on your site selling a customer a token good for a car wash you would not have to collect sales tax from this customer whether they paid with cash or credit card as long as the customer was not assisted after that moment.   They would have to pull up to your coin operated equipment unassisted to receive their wash.  Tom also stated that their position on this was reviewed by their audit department and they were strongly defending this position.

Current DRAFT of the bulletin you can view here.

The final bulletin will be available online in a few weeks at the following link:
